Welcome to Swapo! These Terms of Use (“Terms”) govern your access to and use of the Swapo app and services. By using Swapo, you agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms

By accessing or using Swapo, you agree to these Terms. If you don’t agree, please do not use the app.

2. Description of Service

Swapo is a platform that allows users to:

• List items for trade or swap
• Browse items listed by others
• Communicate through our messaging system
• Complete exchanges using tokens

3. User Accounts

To use Swapo, you must:

• Be at least 13 years old (or the age required in your jurisdiction)
• Provide accurate, up-to-date information during registration
• Keep your account credentials secure
• Be responsible for all activity that occurs under your account

4. Prohibited Activities

You agree not to:

• List or trade illegal, stolen, or counterfeit items
• Use Swapo for unlawful purposes
• Harass, abuse, or harm other users
• Post false, misleading, or deceptive content
• Attempt to access parts of the app you're not allowed to
• Interfere with or disrupt the proper functioning of Swapo
• Violate applicable laws or regulations

5. Child Safety and CSAE Prohibition

Swapo strictly prohibits Child Sexual Abuse and Exploitation (CSAE) content and activities. This includes but is not limited to:

• CSAE Content: Any content that depicts, describes, or promotes child sexual abuse or exploitation
• Child Exploitation: Any activity that exploits, harms, or endangers minors
• Inappropriate Contact: Any attempt to contact minors for inappropriate purposes
• Child-Related Items: Listing items that could be used to exploit or harm children
• Grooming Behavior: Any behavior intended to build trust with minors for exploitation

Zero Tolerance Policy: Swapo maintains a zero-tolerance policy for CSAE. Any violation will result in:

• Immediate account termination
• Reporting to appropriate law enforcement authorities
• Permanent ban from using Swapo services

Reporting: If you encounter CSAE content or behavior on Swapo, immediately report it to us at hey@swapo.ae and to the appropriate authorities.

6. Child Safety Policy

Swapo is committed to protecting children and maintaining a safe environment for all users. Our comprehensive child safety measures include:

• Age Verification: Users must be at least 13 years old to use Swapo. We may implement additional age verification measures as required by law.
• Content Monitoring: Swapo uses automated systems and human review to detect and remove inappropriate content, especially content that may harm minors.
• User Reporting: Users can report suspicious behavior or inappropriate content through our in-app reporting system or by contacting us directly.
• Law Enforcement Cooperation: Swapo cooperates fully with law enforcement agencies investigating CSAE or other illegal activities.
• Regular Policy Updates: We regularly review and update our child safety policies to ensure they meet the highest standards.
• Staff Training: All Swapo team members receive training on child safety and CSAE prevention.

Parental Guidance: Parents and guardians are encouraged to monitor their children's use of Swapo and educate them about online safety.

7. Content and Intellectual Property

• You retain ownership of the content you post.
• By posting, you grant Swapo a license to display, distribute, and modify your content as needed to provide the service.
• We may remove content that violates these Terms.

8. Listings, Trades & Tokens

• Swapo facilitates trades between users; we are not a party to these exchanges.
• You are fully responsible for your own transactions, including meeting in person, verifying items, and completing the exchange.
• Our token system allows you to earn and spend tokens within the app.
• Tokens have no monetary value and can’t be redeemed for cash.
• We may modify or discontinue the token system at any time.

9. Content Moderation & Safety

• Swapo may use automated systems (e.g., image moderation) to review listings and content.
• We reserve the right to remove or block any content that violates these Terms or the community guidelines.
• Repeat violations may result in account suspension or termination.

10. Disclaimers & Limitation of Liability

• Swapo is provided “as is” and “as available,” without warranties of any kind.
• We do not warrant that the app will be error-free, secure, or always available.
• Swapo is not liable for any indirect, incidental, or consequential damages arising from your use or inability to use the app.
• We are not responsible for disputes or losses resulting from interactions or trades between users.

11. Termination

• We may suspend or terminate your access at any time if you violate these Terms or for any other reason.
• You may also terminate your account at any time via the app or by contacting us.

12. Changes to Terms

We may update these Terms at any time. When we do, we’ll notify you via the app or email. Continued use after changes means you accept the revised Terms.

13. Governing Law & Disputes

These Terms are governed by applicable laws in your jurisdiction. Any dispute or claim relating to these Terms or Swapo will be resolved under binding arbitration.
